BUYER

The BUYER refers to the natural or legal person who purchases products through the Seller's website. The BUYER's name, surname, billing and delivery address, telephone number and e-mail address are the information entered during the ordering process and form an integral part of this Agreement.

2. SUBJECT OF THE AGREEMENT

This Distance Sales Agreement regulates the rights and obligations of the SELLER and the BUYER regarding the sale and delivery of the products ordered electronically through pogadgets.com, in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

3. PRODUCT INFORMATION

The following information regarding the purchased products forms an integral part of this Agreement:

  • Product name
  • Brand / Model
  • Quantity
  • Color / Variant
  • Unit price
  • Total order amount
  • Shipping fee (if applicable)
  • Payment method

These details are presented to the BUYER during checkout and in the order confirmation e-mail.

Product availability is subject to stock status.

4. ORDER, PAYMENT AND DELIVERY

The BUYER declares that, before confirming the order, they have reviewed and accepted:

  • Product specifications
  • Total purchase price
  • Shipping charges
  • Delivery conditions
  • Payment method
  • Preliminary Information Form

Orders become effective once payment has been successfully completed.

Unless otherwise stated, products shall be delivered within the estimated delivery period indicated on the website and in any event no later than 30 (thirty) days as required by applicable Turkish legislation.

The SELLER shall deliver the products complete, undamaged and in accordance with the order.

If delivery becomes impossible due to force majeure or unforeseen circumstances beyond the SELLER's reasonable control, the BUYER shall be informed without undue delay.

5. RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from this Agreement within 14 (fourteen) days from the date the product is delivered, without giving any reason and without incurring any penalty.

To exercise this right, the BUYER must notify the SELLER by e-mail before the expiry of the withdrawal period.

After submitting the withdrawal request, the BUYER must return the product within 14 days.

Upon receipt and inspection of the returned product, the SELLER shall refund all payments received from the BUYER using the original payment method, provided the legal return conditions are met.

6. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with Article 15 of the Regulation on Distance Contracts, the right of withdrawal does not apply to, including but not limited to:

  • Products manufactured or customized according to the BUYER's personal specifications.
  • Products whose prices fluctuate depending on financial markets beyond the SELLER's control.
  • Perishable goods or products with a short expiration date.
  • Goods that become unsuitable for return after delivery due to health protection or hygiene reasons where the protective seal or packaging has been opened.
  • Digital content delivered electronically once performance has begun with the BUYER's prior consent.
  • Services that have been fully performed with the BUYER's approval before the withdrawal period expires.

7. SHIPPING

Orders are generally dispatched after payment confirmation.

Estimated delivery time is 7–21 business days, depending on destination and logistics operations.

International deliveries may be delayed due to customs inspections, local regulations or force majeure events.

Shipment tracking information is provided by e-mail once the order has been dispatched.

8. RETURNS AND REFUNDS

Returned products must:

  • Be unused.
  • Be undamaged.
  • Be returned in their original packaging.
  • Include all accessories, manuals and promotional items received with the order.

Unless the return results from a defective, damaged or incorrectly delivered product, return shipping costs shall be borne by the BUYER.

Refunds are processed after inspection of the returned goods and are completed within the legally prescribed period through the original payment method.

9. DEFECTIVE PRODUCTS

If the delivered product is defective, damaged during transportation or does not correspond to the order, the BUYER should notify the SELLER as soon as possible.

The BUYER's statutory rights arising from consumer protection legislation remain fully reserved.

10. PERSONAL DATA

The SELLER processes personal data in accordance with Law No. 6698 on the Protection of Personal Data (KVKK) and applicable legislation.

Personal data is processed solely for purposes including:

  • Order processing
  • Payment processing
  • Delivery
  • Customer support
  • Legal obligations

11. APPLICABLE LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by the laws of the Republic of Türkiye.

In disputes arising from this Agreement, Consumer Arbitration Committees and Consumer Courts having jurisdiction under the applicable legislation shall be authorized.

12. ENTRY INTO FORCE

By completing an order electronically on the website, the BUYER confirms that they have:

  • Read this Agreement,
  • Understood its contents,
  • Accepted all provisions, and
  • Approved it electronically.

This Agreement enters into force on the date the BUYER completes and confirms the order electronically.
